Terms of Service

These Terms of Use (“Terms”) govern your access to and use of the redNote platform, software, applications, and related services (“redNote”, “the Service”), operated by AVA Semarak Berhad (“we”, “us”, “our”).

We know legal terms are rarely exciting, but they matter. These Terms explain what redNote provides, how it works, and the responsibilities and limits that apply to both you and us.

By accessing or using redNote, you agree to these Terms.


1. Nature of the Service

redNote is a conditional encryption and sealed-file delivery platform.

  • redNote allows users to encrypt files locally into a proprietary sealed format (.rednote.sealed).

  • Users define unlock conditions, authorized recipients, and verification rules at the time of encryption.

  • redNote does not store, read, or manage the contents of encrypted files.

  • Encrypted files may be stored, transmitted, or delivered by users using third-party channels (such as email, messaging platforms, or personal storage).


redNote is not:

  • A messaging service

  • A cloud storage provider

  • A document escrow agent

  • A legal executor or estate administrator

  • A guarantor that messages will be delivered or unlocked


2. Eligibility and Age Requirements

You must:

  • Be at least 18 years old, or

  • Have legal capacity under the laws of your jurisdiction

By using redNote, you confirm that you meet these requirements.


3. Relationship Between You and Us

redNote provides software and cryptographic mechanisms, not custodial services.

  • You retain full ownership and responsibility for your files and content.

  • We do not act as a trustee, custodian, agent, or representative for your content.

  • No fiduciary, partnership, or agency relationship is created by using redNote.


4. What You Can Expect From redNote

We aim to:

  • Provide access to the redNote platform and features as described

  • Implement encryption, rule enforcement, and verification logic as designed

  • Operate the service in accordance with stated security and privacy principles

  • Improve, update, or modify the service responsibly over time

However, redNote does not guarantee:

  • That a file will be delivered, received, or unlocked

  • That recipients will successfully complete verification

  • That third-party platforms used for delivery will remain available

  • That the service will meet specific legal, estate, or inheritance requirements


5. What We Expect From You

You agree that you will:

  • Use redNote only for lawful purposes

  • Ensure that recipients you designate are correct and reachable

  • Safeguard your credentials, sealed files, and encryption outputs

  • Understand the consequences of encryption and conditional locking

You acknowledge that:

  • Lost sealed files cannot be recovered

  • Incorrect conditions or recipients cannot be overridden

  • redNote cannot unlock, reset, or bypass encryption on your behalf


6. User Content and Responsibility

All content encrypted using redNote remains your sole responsibility.

You agree that you will not use redNote to:

  • Encrypt or distribute illegal content

  • Violate intellectual property rights

  • Circumvent laws, court orders, or regulatory obligations

  • Harm, threaten, or defraud others

redNote does not review, monitor, or moderate encrypted content.


7. Software License

We grant you a limited, non-exclusive, non-transferable, revocable license to use redNote software and services in accordance with these Terms.

You may not:

  • Reverse engineer, decompile, or tamper with the software

  • Circumvent security, encryption, or verification mechanisms

  • Misrepresent redNote as providing guarantees it does not offer


8. No Refund Policy

Unless otherwise stated:

  • Payments made for redNote Premium or related services are non-refundable

  • This reflects the immediate availability of software features upon purchase


9. Availability and Modifications

We may:

  • Modify, suspend, or discontinue parts of the service

  • Introduce new features or retire existing ones

  • Update these Terms when necessary

Material changes will be reflected by an updated “Last Updated” date.


10. Limitation of Service Responsibility

You understand and agree that:

  • redNote does not store encrypted files or message content

  • redNote cannot confirm death, incapacity, or real-world events beyond its defined verification processes

  • Unlock conditions rely on system rules and user-defined parameters, not human judgment

The system enforces rules as configured, not as intended or hoped.


11. Dispute Resolution and Governing Law

These Terms are governed by the laws of Malaysia, without regard to conflict-of-law principles.

Any disputes arising from these Terms or use of redNote shall be subject to the exclusive jurisdiction of Malaysian courts, unless otherwise required by law.


12. About These Terms

If any part of these Terms is found unenforceable, the remaining sections will continue to apply.

Failure to enforce any provision does not constitute a waiver.
